The Civil Law II course aims to help the student to achieve the following goals: - Knowledge and understanding of inheritance and succession law (getting and mastering general and specific knowledge in the field of inheritance law) - Ability to apply knowledge and understanding (ability to use knowledge and skills to solve problems and practical cases) - Independent judgement (ability to gather and interpret data useful for making independent judgements, including reflection on social and ethical issues) - Communication skills (ability to communicate information, ideas, problems and solutions to specialist and non-specialist audiences) - Learning skills (development of the skills necessary to continue studying independently or in a structured manner)
Course Prerequisites
A solid knowledge of private law is essential. For this reason, it is recommended that students review the fundamental concepts of of inheritance law and succession upon death before or while studying for the civil law exam. Students can only take the Civil II exam if they have already passed the Civil I exam.
Teaching Methods
The course takes place over 40 hours in the first semester. Lessons will be held in person. During the lesson, a PowerPoint presentation will be shown to support the explanations and will be uploaded to the course's e-learning platform. The lesson will be divided into a theoretical part and a practical part, with discussion of concrete cases.
Assessment Methods
The assessment will be through an oral exam, with the final grade out of thirty (30/30). The assessment will take into account the in-depth knowledge of the rules and principles of inheritance and succession law, the knowledge of scholars' opinions and case law, the ability to independently critically rework material, and the ability to speak and argue.

The Civil Law II course aims to provide students with an in-depth knowledge of succession upon death, coordinating this discipline with other civil law disciplines such as property, family and business law. The following topics will be covered in particular: - Succession due to death as a phenomenon of succession in property rights; Article 42 of the Constitution - The concept of heir and legatee. The devolution of inheritance. The prohibition of succession agreements. - Legitimate succession; succession of the spouse and succession of relatives - Testamentary succession - Necessary succession - The inheritance common ownership - Pathology: (1): Remedies to protect the forced heir: the action for reduction - Pathology: (2): challenging a will - Pathology: (3): the action to claim inheritance.
