The course of Civil Law is divided into two parts, which deal with obligations (part I) and contract (part II). Both the parts of the course are provided in the first semester.
Course Prerequisites
In order to take the exam of Civil Law students must have already passed the exams of Private Law and Constitutional Law. A good knowledge of the fundamental basis of Private Law is required
Teaching Methods
Learning activities consist of 40 hours of lectures held by the Professor. Lessons consist in a theoretical part aimed at illustrating principles and rules of the law of obligations integrated by a part based on law cases, with texts read and commented during classes with students’ direct involvement in order to develop abilities that only through direct guide and interaction can be developed and enhanced.
Assessment Methods
The exam consists of an oral test focused on the whole content of the course (part I and part II), i.e. an interview aimed at ascertaining the students’ knowledge of the subjects of the course, their understanding, the acquisition of appropriate language, the ability to synthesize and rework. At the end of the first part of the course (part I, IV year) only attending students may take a partial oral test on the program of this module. In the student's career, the grade of the civil law exam will in any case be uniform and will be recorded after having taken the exam in the fifth year
Contents
The first part of the course (Civil law – Part One) deals with obligations (art. 1173 – 1320 c.c.). In particular, the course deals with: basic concepts and general principles; types of obligation; debtors, creditors and change of parties; set-off and merger; extinction of obligations; place and time of performance; liability and remedies for non-performance.
