Course Objectives
This course addresses legal issues related to advertising and e-commerce, with a particular focus on the fashion industry. It offers a dual perspective: comparative and socio-legal. The objective is to highlight the various challenges the law faces in regulating the constantly evolving world of marketing and advertising, especially in light of ongoing technological developments. These changes raise important questions about the effectiveness and potential rapid obsolescence of existing legal frameworks. The fashion industry, due to its significant economic relevance and its influence on culture and social trends, provides a particularly compelling case study for these issues. By the end of the course, students will be able to: - demonstrate a solid understanding of the fundamental concepts related to the regulation of offline and online advertising, both generally and with specific reference to the fashion sector, with attention to the protection of businesses and consumers; - navigate the various regulatory frameworks for commercial communication developed at the national and supranational levels, from a comparative perspective; - critically assess the effectiveness and real-world impact of advertising regulations as applied to digital media.
Course Prerequisites
Having passed the fundamental exams relevant to the year of course attendance.
Teaching Methods
The course takes place during the first semester and consists of a total of 50 hours. An interdisciplinary approach will be adopted, featuring seminar-style lectures and discussions on practical cases and materials. Slides will also be used as teaching aids; these will be reviewed during class and made available to attending students on the e-learning platform.
Assessment Methods
A single oral examination will be held for both modules, and the final grade will be awarded on a scale of 30. The exam will cover the topics presented during the course. For attending students, assessment will be based on knowledge of the subjects discussed in class, supported by the textbook and additional materials provided by the instructors (e.g., slides and academic articles; see the Leganto platform and the course’s E-learning page for details). For non-attending students, assessment will focus on the topics covered in the textbook and the supplementary materials that will be specified during the academic year (also available on the Leganto platform and on the course’s E-learning page). Evaluation criteria include not only the ability to clearly present the course content, but also active participation and the capacity to address practical problems.
Contents
Professor Pozzo’s Module (25 hours): this module will focus on the regulatory frameworks governing advertising and product placement within the broader context of commercial communication. Particular attention will be given to issues such as gender stereotypes in advertising, the intersection of fashion, artificial intelligence, and gender representation (including genderless and gender-fluid fashion), as well as European regulations aimed at promoting greater sustainability within the textile and fashion sectors. Professor Reale's module: this module will address the emergence of self-regulation in the field of advertising, with particular reference to the Italian experience, and the rules developed specifically to ensure the correctness of online commercial communication. The advantages of self-regulation in the fashion sector will be illustrated, and practical cases will be presented for discussion with students, potentially involving experts from the industry
