Course Objectives

Learning Objectives and Expected Learning Outcomes
The primary goal of this course is to provide students with an institutional understanding of Roman public law and constitutional structure from the Regal period to the Justinianic era. More specifically, the following objectives are pursued:
Knowledge and Awareness
1. Of the historicity of law, as both an intellectual and social phenomenon.
2. Of the complexity of legal phenomena and their relationships with political, socio-economic, and cultural conditions.
3. Of the utility of an interdisciplinary approach to legal phenomena.
4. Of the basic lexical framework concerning legal institutions and, more generally, the diverse manifestations of Roman public law.
Ability to Apply Knowledge and Understanding
1. To recognize the fundamental junctures of the historical-legal trajectory covered in class.
2. To place legal events within their historical, political, economic, and social context.
3. To identify the cause-and-effect relationships connecting these events.
4. To analyze the sources and documents examined in class.
5. To apply an interdisciplinary approach to the study of legal phenomena.
6. To explain, using technical language and a logical and systematic order, the historical-institutional aspects and, more generally, the various phenomena of Roman public law.
Autonomy of Judgment
1. Ability to compare and critically analyze Roman public legal structures and institutions with contemporary ones.
2. Capacity for critical analysis of the historical-legal facts considered in class.
3. Ability to grasp the historical, cultural, political, social, and economic reasons that condition or determine choices in the field of public law.
4. Capacity for critical analysis of the sources and documents examined in class.
Communication Skills
Ability to present acquired knowledge through an organically and logically constructed discourse, utilizing appropriate terminology.

Course Prerequisites

For an easier understanding of the topics and themes covered, an elementary knowledge of the political-social history of Rome, acquired during previous higher education courses, is required.

Teaching Methods

The course takes place in the second semester. Teaching activities will consist of lectures (for a total of 50 hours).

Assessment Methods

Learning assessment for all students will occur through an oral examination, covering:
• a. The entire course program for non-attending students and for attending students (students who have consistently followed lessons) who did not achieve a passing grade in the intermediate written test (see below).
• b. The part of the program not tested in the intermediate written test for attending students who achieved a passing grade in the intermediate written test (see below).
The final grade will be awarded on a scale of thirtieths (e.g., /30).
The assessment will consider:
• Firstly, the level of knowledge demonstrated by the student regarding the topics of the course program.
• Furthermore, the correct use of technical-legal terminology.
• The logical and orderly organization of the discourse, including connections and comparisons between different topics, demonstrating the degree of assimilation of the studied material.
For attending students, learning will also be assessed through an intermediate written test (scheduled during the period of lectures). Both during the oral exam and the intermediate written test, attending students may use the material uploaded to the e-learning platform related to the course.
For non-attending students, specific additional information or resources will be provided.

Contents

Given the necessity of tracing a historical-legal system that unfolded over more than thirteen hundred years (from 753 B.C., the mythical founding of Rome, to 565 A.D., the year of Justinian's death), the following chronological and systematic-expository division will be observed:
• Regal Period (753 B.C. - 509 B.C.)
• Roman Republic (509 B.C. - 23 B.C.)
• Imperial Age (23 B.C. - 284 A.D.)
• Post-Classical and Justinianic Age (284 A.D. - 565 A.D.)

Office Hours
The lecturer will dedicate 2 hours per week to student reception (barring academic commitments), on a fixed day to be specified via online announcements. The lecturer remains fully available for questions during and after each lesson and to arrange appointments upon request for specific needs.
