abstract:
The article proposes, in its first part, a general reflection on the opportunity to overcome the model of purely retaliatory criminal justice through the introduction of restorative justice methods and practices. The reflection starts from the awareness that restorative justice represents a choral dream, the contents of which are progressively recognized in supranational legislation and promoted in some reforms in the Italian penal system. In the second part, the article proposes a recognition of the reforms of the Italian penal system aimed at mitigating the "retribution" paradigm and at introducing and enhancing the possibility of resorting to restorative justice.
