Sapienza del diritto e saggezza della giustizia: l’attenzione alle emozioni nella normativa sovranazionale in materia di restorative justice

The essay explores the relevance of emotions within the main supranational regulatory sources on restorative justice: Directive 2012/29 / EU and Recommendation CM / Rec 2108 (8). The analysis starts from the content and linguistic recognition of the main emotions normally related to the victimization experience that are recognized in the above mentioned sources. These emotions are then grouped into three macro-areas that refer to: fear (and the related needs for special protection of the victims); listening (and the correlative right of victims to an individualized assessment) and relationality (and the correlative need for trust that nourishes, in the victims, their capacity of resilience and the ability to experience closure).
