abstract:
The essay deals with suspensive-probation measures with a comparative perspective. The legal systems considered are the Swedish and the Finnish legal systems.
Starting from the concept of "Nordic penal exceptionalism", the work examines legislation, but with a constant attention to empirical data about concrete application, concerning the suspensive-probation measures (probation, community measures, conditional release, community service, electronic monitoring, combined penalty).
A SWOT-type analysis of suspensive evidentiary measures concludes the survey.
