The essay focuses on the "foundational" component of the comprehensive discipline of restorative justice introduced by Legislative Decree No. 150/2022, centered on definitions, general principles, objectives, and goals of application of restorative justice in the Italian penal system. Constant attention is given to supranational aspects and indications of the enabling law in order to illustrate the meaning of the choices made by the Italian legislature.
