abstract:
The interpretation of the concept of iniuria, as reported in the lex Aquilia, probably influenced the idea, which the Roman jurists expresed explicity, that the collectivity could not have psichological behaviors. Nevertheless the sources, even if the modern concept of legal person was unknown, seem to show that the crime of a single belonging to a collectivity could bring to the liability of the collectivity itself.
