Course Objectives

This mandatory course provides the necessary completion of the Criminal law course, concerning the general architecture of the Criminal Justice System; further possibilities to enlarge competencies in criminal matters are offered by the following not mandatory courses: "Commercial Criminal Law" and "Restorative justice and mediation".
The Advanced Criminal Law Course deals with the analysis of two sets of criminal norms: crimes against the individual and sanction system and sentencing. The analysis of the above mentioned norms requires constant references to the principles, structures, mechanisms and implementation of the general part of the Italian Criminal code and a good knowledge of the interpretative techniques of the criminal law and of the supranational legal framework.
At the end of the course, students should demonstrate appropriate skills in relation to the following aspects: (a) contents of the main criminal norms against the individual; (b) sentencing.
It also aims to promote an improvement of criminal policy options comprehension.
From A.A. 2020/21, the advanced criminal law course is provided only in the 6 CFU formula for a total of 35 hours of teaching, intended for students in the third year of the course. It intends to offer in-depth knowledge in relation to the sanctioning system, thus placing itself in the Anglo-Saxon forms of a course of sentencing and includes notions of judicial psychology.

Course Prerequisites

An adequate knowledge of Constitutional Law, Criminal Law and the key elements of UE law and supranational law are required and essential to a full understanding of the Advanced Criminal Law Course.

Teaching Methods

The course takes place in the second term, through 35 hours of lecture, and is enriched by the contribution of knowledge offered by Italian or foreign guests from academia, the judiciary or the Italian Bar Association.
Teaching includes theoretical lessons, designed to illustrate the principles and contents of criminal law and criminological issues
Papers, criminological surveys, power-point presentations, judgements and other scientific materials may be available on the e-learning platform.

Assessment Methods

Oral examination over the entire programme, maximum grade is 30, minimum 18, conducted in the way of an inverted cone: a general question followed by some more specific questions that open up further perspectives of verification.
Will be assessed in particular the ability to report the contents of the program as appropriate to the specific nature of matter the ability to connect the various institutes of criminal law, argumentation skills, technical and expressive skills.

The course deals with two sets of criminal norms: sentencing and crimes against the individual.

 art. 575 c.p., murder; 577bis, femicide;
 art. 578 c.p., newborn homicide in particular conditions;
 art. 579 c.p., murdere with consent art. 580; cooperation in suicide;
 art. 589 c.p., manslaughter;
 art. 589-bis c.p., road non voluntary homicide;
 art. 589-ter: escape from road homicide;
- Part I, Chapter 4, pp. 75-80 e 85-86, following crimes:
 art. 582 and 583 c.p., injuries;
 art. 581 c.p., battery.
- Part II, Chapter 2, section 2, pp. 237-257, art. 612-bis, crime of stalking.
Part III, chapter 1, pp. 281-294.
art. 609-bis, crime of rape.

Le tesi in Diritto penale base e in Diritto penale progredito sono assegnate agli studenti che rispettino i seguenti criteri:
1) abbiano una media di 26/30 e abbiano conseguito in Diritto penale o in Diritto penale progredito una votazione non inferiore a 25/30;
2) abbiano frequentato altra materia penalistica (Diritto penale commerciale o Giustizia riparativa e mediazione penale). Ai fini dell'assegnazione della tesi non è richiesto che il relativo esame sia già stato superato.
In base a quanto deliberato dal Consiglio di Dipartimento, per ciascuna materia possono essere assegnate al massimo 5 tesi l’anno. I titoli di tesi disponibili per ciascuna materia sono sul sito dei singoli corsi e saranno pubblicizzati tramite la bacheca collettiva del Corso di Studi, gestita dalla Prof.ssa Lucia Lopez. È possibile concordare con lo studente altro e diverso argomento.
Si ricorda che nell'ambito del corso di Laurea magistrale in Giurisprudenza è stato avviato il Progetto Syn-Thesis: nuovi percorsi di alleanza didattica per redigere la tesi di laurea, volto promuovere la stesura di tesi di laurea sperimentali, basate su ricerche empiriche o giuridiche innovative ed originali, e spendibili altresì come prodotti di ricerca del Dipartimento di Diritto, Economia e Culture. La tesi di laurea che si iscrive nel progetto Syn-Thesis prevede che lo studente segua un percorso di ricerca in stretta collaborazione con il relatore, sia aperto alla cooperazione con istituti di ricerca ed enti esterni all'Università e arrivi alla formulazione di un testo non necessariamente esteso bensì dai contenuti originali, metodologicamente rigoroso e perciò suscettibile di pubblicazione.
