Nuove regole generali per l'impresa nel Codice della crisi e dell'insolvenza

The article analyzes the new rules for business law and for company and corporation law set by the recent reform of Italian bankruptcy law. It is a novelty that the legislator, while creating new rules to regulate the industrial, economic and financial crisis, creates new rules also for general business law. Interesting amendments have been provided for the law of company directors and for the law of management control, aiming at guaranteeing that any company or corporation could perceive the incoming of a crisis as early as possible, and could shape and implement timely measures of reor-ganization to enable the firm to overcome the crisis. This article evaluates the efficacy of these new rules, as well as their harmonization with the rules of the new Code of the Crisis.
