L'acquisizione della prova dichiarativa cartolare: la recente sentenza della sez. II n. 19864/19 nel prisma della giurisprudenza della Corte EDU. The Acquisition of Pre-Trial Declarations As Evidence.

La II sezione della Corte di Cassazione ha recentemente applicato (sent. n. 19864/19) i principi di diritto contenuti nelle sentenze della Corte europea dei diritti dell’Uomo nei casi Al Khawaja e Thaery c. Regno Unito del 2011 e Schatschaschwili c. Germania del 2015, entrambe in tema di acquisizione di dichiarazioni predibattimentali in assenza di contraddittorio. La sentenza è esami- nata con l’obiettivo di evidenziare l’evoluzione giurisprudenziale nazionale in tema di artt. 512 c.p.p. e 526 comma 1-bis c.p.p., conseguente alle pronunce della Corte EDU in merito alla violazione dell’art. 6 comma 1 e 3 lett. d) CEDU.

The II criminal section of the Italian Court of Cassation has recently implemented (n. 19864/19) the principles as part of the judgments of the European Court of Human Rights, in the cases Al Khawaja and Thaery vs. the United Kingdom, 2011, and Schatschaschwili vs. Germany, 2015, both on the topic of acquisition of pre-trial declarations in the absence of cross-examination. This ruling has been examined with the aim to highlight the Italian jurisprudential evolution in terms of articles 512 and art. 526-1° bis c.p.p., after the judgments of the ECHR Court regarding the violation of art. 6 § 1 and § 3 d) ECHR.
