BENARAFA JIHANE

Jihane Benarafa is a tenure-track Researcher in Comparative Private Law at the Department of Human Sciences and Innovation for the Territory of the University of Insubria. She has obtained the Italian National Scientific Qualification for the position of Associate Professor in the scientific-disciplinary group 12/GIUR-11, Comparative Law. She is a member of the UNESCO Chair “Gender Equality and Women’s Rights in the Multicultural Society”, whose Chairholder is Professor Barbara Pozzo, established at the University of Insubria in 2018 to develop and enhance knowledge and awareness of human rights, with particular regard to women’s rights and their right to participate actively in public life. Her research activity falls within the field of comparative law, with specific attention to consumer law, sustainability, legal pluralism and the Islamic legal tradition. Her main scientific interests concern the Sharia-compliant financial and insurance sector, the halal market, consumer protection from an intercultural perspective, the circulation of legal models and the relationship between law, religion, market and sustainability. She is the author of the monograph “Il Takaful oltre il legal transplant. L’etica islamica di fronte al rischio assicurativo”, published by Giappichelli in 2024, as well as of numerous scientific contributions on Islamic finance, comparative law, sustainability, the halal market, technological innovation and Muslim legal systems. She has acquired extensive teaching experience at the University of Milan, the University of Insubria and in advanced training contexts, including at the School of Economic and Financial Police. She has carried out teaching and supplementary teaching activities in Comparative Private Law, Comparative Legal Systems, Private Law in Europe and Latin America, Sustainability and Food Safety, as well as in doctoral and postgraduate courses. She has participated, as a speaker and as a member of organising committees, in national and international conferences devoted to comparative law, Islamic finance, sustainability, the halal market, climate migration, property and the relationships between law, culture and religion. She has also undertaken research periods abroad at the Institut de droit comparé in Lausanne, Université Panthéon-Assas Paris II and Université de Strasbourg.
